01 Description of Service

We provide an AI-powered chatbot that is embedded on real estate professionals' websites to capture lead inquiries. When a website visitor interacts with the chatbot and submits their contact information, an automated SMS notification is sent to the subscribed real estate agent.

02 Eligibility

Our Service is intended for use by licensed real estate agents, brokers, and real estate businesses ("Subscribers"). By subscribing, you confirm that you are a business entity or individual using the Service for legitimate professional purposes.

03 SMS Notification Consent

By subscribing to our Service and providing your phone number during onboarding, you explicitly consent to receive automated SMS text message notifications from HauzGenie via Twilio whenever a new lead submits their contact information through your chatbot. These messages will contain lead details such as name, phone number, email, and inquiry content.

• Message frequency depends on lead volume on your website.
• Message and data rates may apply.
• You may opt out at any time by replying STOP to any SMS notification.
• Reply HELP for assistance.

04 Subscriber Responsibilities

As a Subscriber, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws.
• Not use the Service to send spam or unsolicited messages to end users.
• Ensure your website includes appropriate privacy disclosures for visitors who interact with the chatbot.
• Maintain the confidentiality of your account credentials.

05 Data Collection and Privacy

We collect contact information submitted by website visitors through the chatbot solely for the purpose of delivering lead notifications to the subscribed real estate agent. We do not sell, rent, or share this data with third parties.

06 Intellectual Property

All content, software, and technology associated with the Service is the exclusive property of HauzGenie and is protected by applicable intellectual property laws. Subscribers may not copy, reproduce, or distribute any part of the Service without prior written consent.

07 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation of the Service and are not responsible for delays caused by third-party providers including Twilio.

08 Limitation of Liability

To the fullest extent permitted by law, HauzGenie shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

09 Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or engage in conduct we determine to be harmful to the Service, other users, or third parties.

10 Changes to These Terms

We may update these Terms from time to time. We will notify Subscribers of significant changes via email or in-app notification. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
